Mark Paluch opened DATAMONGO-2154 and commented

Right now, we cannot use array matching operators such as $elemMatch within an array of DBRef's expressed as MongoDB JSON due to limitations in MongoDB's JSON parser. The following query would fail with a parse exception:

@Query(value = "{ 'fans' : { '$elemMatch' : { '$ref' : 'user' } } }")
Person findWithDbRef();

We should revisit this ticket once MongoDB's utilities are able to parse partial DBRefs.
