Description
Using python 3.8. Trying to build setuptools fails wih the following message on my system:
error: cannot copy tree 'build/scripts-3.8': not a directory
simply creating an empty directory 'build/scripts-3.8' was apparently a successful workarond, but I feel the error should not have occured.

Research direction
Start by reproducing the setuptools build with Python 3.8 and trace how the build/scripts-3.8 path is created and copied. Done means the build succeeds without manually creating an empty build/scripts-3.8 directory.
