Description

## Background
One of the key legislative outcomes of the Short-term Rental Accommodations Act is to provide Local Governments (LG) with more tools and resources to enforce bylaws that regulate short-term rentals within their community.

Each Local Government in British Columbia approaches short-term rentals differently: some LGs allow property owners to offer short-term rentals without limitation or registration requirement, while others - often in areas with high-population density and low housing availability - have stringent Conditions that must be satisfied in an ongoing manner if a property is to be used for short-term rentals.

To reflect the varying requirements of Local Governments across British Columbia, the Short-term Rental Registry has collated and enumerated the following list of obligations which can be placed upon a Registration as a Condition of its approval:

- The host must use this unit as their Principal Residence
- The host must use this property as their Principal Residence
- The host must have a valid business licence
- Offers and Bookings must be a minimum of one month
- Offers and Bookings must be a minimum of two months
- This Short-Term Rental must maintain a Class 9 Farm Land designation to be exempt from the Principal Residence requirement
- This Short-Term Rental must remain part of a Strata Hotel building and to be exempt from the Principal Residence requirement
- This Short-Term Rental property must remain subject to a Fractional Ownership Agreement to be exempt from the Principal Residence requirement

Short-term rental properties in British Columbia may have zero, one, or more of these Conditions attached to the Registration that must be satisfied at all times to keep the Registration in good standing. If a rental property is suspected to be not in compliance with one or more of the Conditions of the Registration, the Registrar (or delegate) may choose to begin a Notice of Consideration (NOC) or "open submission" process as a means of obtaining supporting information from the Host to verify adherence to the attached Conditions. If the Host is determined to be not in compliance, then the Registration may Suspended, Cancelled, or referred to the Compliance and Enforcement Unit (CEU).

Please note that it is preferable to use the language "Registered with Conditions" instead of "Conditional Approval" as the difference is subtle yet important: "Registered with Conditions" strongly indicates that a Registration has been created but has Conditions attached that must be satisfied for the Registration to remain in-effect; by comparison, "Conditional Approval" may mislead some applicants to believe that their approval has not (yet) been determined concretely and could be confused with the unrelated concept of "Provisional Approval".

### Desired Business Outcomes

1. Ability for an Examiner to attach one or more Conditions when approving a Registration, either initially, during Reinstatement (from a Suspension), or following a Set Aside.

### Desired User outcomes

1. Ability for a Host to determine the Conditions, as mandated by the Short-term Rental Registry on behalf of a Local Government, that must be satisfied in order to keep their Registration in good standing.
